Law in England and Wales since 1997
There is still a lack of awareness of the necessity to serve notice if undertaking work to a party wall, party fence wall or excavating below the depth of neighbours foundations within 3 or 6 metres of their property. Appointed on a diverse range of sites from London to Lincoln, Mumford & Mumford are happy to discuss the complexities of the Act with you.
Work commenced without the correct notices served and a Party Wall Award in place can be stopped by injunction. Essentially the Party Wall etc Act 1996 is a very practical piece of legislation which allows work covered by the act to be done whilst giving adjoining owners protection.
If you have received a notice or think you may need to serve notice for your development contact us and ask to speak to a Party Wall Surveyor. |
